WEEK IN REVIEW – SOUTH BEND
South Bend, Indiana -- The United States Attorney’s
Office announced that:
PLEAS:
Ø Juan Orduno, 26, pled guilty before Magistrate Judge Christopher Nuechterlein to the felony offense of possession of a
firearm as a convicted felon. Magistrate
Nuechterlein is recommending that the district court
accept the tendered guilty plea. Parties
have 10 days in which to object to the magistrate judge’s recommendation.
Sentencing has been set for 10/26/12.
These charges were filed as the result of an investigation by the by the
Bureau of Alcohol, Tobacco, Firearms and Explosives. This case is being prosecuted by Assistant
United States Attorney Donald Schmid.
Ø Cortey Edwards, 22, of Lima, Ohio, a defendant in the case US v Diallo et al.,
pled guilty before Judge Robert Miller, Jr. to the felony offense of possession
of 15 or more counterfeit access devices and unauthorized access devices with
the intent to defraud. Sentencing has
been set for 10/29/12. These charges
were filed as the result of an investigation by the United States Secret
Service, the Wabash County Prosecutor’s Office and the Wabash County Sheriff’s
Department. This case is being
prosecuted by Assistant United States Attorney William Grimmer.
Ø Jason Gray, 38, of Lake Station, Indiana, pled guilty
before Judge Robert Miller, Jr. to the felony offense of possession of a
firearm while being an unlawful user of a controlled substance (marijuana). Sentencing has been set for 11/5/12. These charges were filed as the result of an
investigation by the Drug Enforcement Administration. This case is being prosecuted by Assistant
United States Attorney Frank Schaffer.
Ø Nolberto Robledo, 35, of San Jose, California,
a defendant in the case US v Beltran et
al., pled guilty before Judge Robert Miller, Jr. to the felony offense of
possession with the intent to distribute and distribution of cocaine. Sentencing has been set for 10/31/12. These charges were filed as a result of an
investigation by the Drug Enforcement Administration. This case is being prosecuted by Assistant
United States Attorneys William Grimmer and Frank Schaffer.
If convicted in
court, any specific sentence to be imposed will be determined by the judge
after a consideration of federal sentencing statutes and the Federal Sentencing
Guidelines.
DISPOSITIONS:
Ø Billy Ray Bowen, 49, of Michigan City, Indiana, was sentenced by
Judge Robert Miller, Jr. to 78 months imprisonment and lifetime of supervised
release after pleading guilty to the felony offense of possession of child
pornography. According to the Plea Agreement
and Sentencing Memorandum filed in this case, Bowen downloaded and stored over
2600 images and videos from the internet depicting child pornography and had
been collecting child pornography for 3 to 5 years. Bowen is also a convicted felon and possessed
6 firearms at the time of a search of his residence. This case resulted from an investigation by
members of the Indiana Internet Crimes Against Children
Task Force, including the Federal Bureau of Investigation and the Michigan City
Police Department. This case was
prosecuted by Assistant United States Attorney John Maciejczyk.
Ø John Bloch III, 35, of Elkhart, Indiana, was sentenced
by Judge Robert Miller, Jr. to 138 months imprisonment and 3 years of
supervised release after being found guilty at trial of the felony offenses of
possessing a firearm as a convicted felon and possession of a firearm after a
domestic violence conviction. According
to the sentencing memorandum file by the government in this case, police were called in response to reports that the
defendant had been firing his weapon in a residential area, constituting
criminal recklessness, a felony under Indiana law. Bloch was a
convicted felon (with a history of violent crime) in possession of multiple
firearms. Police found a handgun loaded with an extended magazine in it. A second extended magazine and more than 100
additional rounds were also recovered.
Bloch has prior convictions for violent offenses, criminal conversion,
and a controlled substance offense. This case was the result of an investigation by the by
the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Elkhart Police
Department. This case was prosecuted by
Assistant United States Attorney Donald Schmid.
Ø Walter Neal, 47, of South Bend, was sentenced by Judge
Jon DeGuilio to 72 months imprisonment, $11,904.71 in
restitution and 3 years of supervised release after pleading guilty to the
felony offense of the robbery of First Source Bank in June 2010. According to the Sentencing Memorandum filed
by the government in this case, Neal has
been arrested 17 times and been convicted 6 times for felonies and four times
for misdemeanors. In two of the cases he was convicted of bank robberies. This
case was the result of an investigation by the Federal Bureau of Investigation. This case was prosecuted by Assistant United
States Attorney Frank Schaffer.
